Abstract
Dissertation Abstract : This thesis was exposed to determining civil liability for the damages of technology operators with artificial intelligence - in short, smart robots - and to that end, the researcher stopped at the practical aspects of smart machines in order to build the most accurate legal results, as the law is linked to various sciences. The legal nature of robots was also discussed, which in the eyes of current laws are just things or machines that require special care that do not have a legal personality; Therefore, the responsibility for its damages is borne by the humanitarian representative, such as the manufacturer or operator, for his contractual breach, or for his breach of his legal obligations as a supplier of modern technology, or for being short on guard duty, or because there is a defect in the robot product, or it may reach the limit of the responsibility of robot manufacturers for While the European Civil Code on robotics indicated that it is of a special nature that requires in the future to give it a new legal personality called the virtual electronic personality, especially in the cases in which robots become more intelligent, and thus the possibility of saying that they bear civil responsibility within legislative controls and special legal procedures such as registration and compulsory insurance, but this statement did not escape criticism and problems as it affects public order and may waste the value of human law. This study aims to establish a legal environment related to artificial intelligence applications at a time when the smart machine began to appear and enter into actions, transactions and contracts, which necessitated posing various legal problems that it raises to develop a legal framework for robots, as the first in-depth analytical legal study.
